In July 2018, the First Circuit Court of Davidson County, Tennessee granted summary judgment in favor of Middle Tennessee Ear, Nose, and Throat dismissing all claims. The claims arose out of a prescription written by a nurse practitioner who had been recently hired by MTENT. The NP wrote the prescription without examining the patient in violation of Tennessee law, rules, and regulations and in violation of MTENT policies and practices. The court dismissed all claims against MTENT including negligent hiring, negligent supervision, and vicarious liability.
