27 Jul Patient v. Wilson County Internist, Eric Miles and Phillip North
In April 2012, Eric Miles and Phillip North obtained a defense verdict on behalf of a Wilson County internal medicine specialist in a wrongful death medical malpractice case. The plaintiff alleged that his wife died due to the failure to timely diagnose and treat an infectious process. Our physician client maintained that he fully complied with the recognized standard of acceptable professional practice and that the decedent’s death was not caused by the alleged infection. The case was tried for approximately two weeks and a Wilson County jury returned a verdict in favor of our client, finding that the plaintiff had failed to establish that he was negligent. The verdict in favor of our client was upheld on appeal by the Tennessee Court of Appeals. The Tennessee Supreme Court denied the plaintiff’s application for permission to appeal. Following the trial, our client was awarded his discretionary costs and a judgment against the plaintiff for those costs has been entered.
