In October 2011, Eric Miles and Phillip North obtained a defense verdict on behalf of a Nashville urologist and his practice group in a medical malpractice case. The plaintiff claimed he suffered loss of sexual function as a result of negligently performed transurethral microwave therapy of the prostate. The defendants disputed any injury and further argued that the care provided to the patient was fully compliant with the recognized standard of acceptable professional practice. After a one week trial, a Davidson County jury returned a verdict in favor of the urologist and his group, finding that the plaintiff had not proven any injury and further finding that the plaintiff had failed to establish any negligence. The defendants were then awarded their discretionary costs and a judgment against the plaintiffs for those costs was entered.
